Terms & Conditions

Occupants The said premises shall be occupied by no more than 6 people. Tenants agrees not to use the property for any illegal or unlawful purposes, including but not limited to the serving or consumption of alcoholic beverages by persons under the age of 21 or use of drugs, nor shall Tenant’s use of the property and any common areas disturb or offend other guests, residents or neighbors. Use of the property will be denied to persons not falling within the foregoing categories. A violation of the provision will result in a termination of this Agreement. Tenant(s) will be required to vacate the property immediately and will not receive a refund of payments made.

Pets No pets shall be brought on the premises without the prior written consent of the Owner.

Ordinances and Statutes Tenant(s) shall comply with all statutes, ordinances and requirements of all municipal, state and federal authorities now in force, or which may hereafter be in force, pertaining to the use of the premises.

Repairs or Alterations Tenant(s) shall be responsible for damages caused by his negligence and that of his family or invitees and guests. Tenant(s) shall not paint, paper, redecorate or make alterations to the premises without the prior written consent of Owner. All alterations, additions, or improvements made to premises with the consent of Owner shall become the property of Owner and shall remain upon and be surrendered with the premises.

Upkeep of Premises The property is the Owner’s personal residence and the Tenant(s) are expected to care for the property as if it were their own. Rearranging furniture is not permitted and owner will retain $150 from the security deposit for returning furniture to its original location. Smoking will be permitted on the outside of the unit on the surrounding patio areas. Tenant is required to notify the Owner of any damage to the property or cleaning concerns on the day of check in. Thereafter any damage or cleaning concerns during the Tenant(s) occupancy will be Tenant(s) responsibility and must be reported to the owner at the time of check out. Tenant(s) shall keep and maintain the premises in a clean and sanitary condition at all times, and upon the termination of the tenancy shall surrender the premises to the Owner in as good condition as when received, ordinary wear and damage by the elements excepted. Clean condition means: all floors swept, all doors and windows locked, all trash removed and emptied into outside cans, refrigerator must be emptied and all items removed. Please do not wash the top bedding.

Assignment and Subletting Tenant(s) shall not assign this agreement or sublet any portion of the premises without prior written consent of Owner.

Utilities/Appliances Owner will be responsible for the payment of all utilities and services. The property is in good faith, maintained to high standards. However, service request for appliance malfunctions will receive a response as quickly as possible. There are no rebates, refunds for any reason in the event of an appliance malfunction.

Default If tenant(s) shall fail to pay rent when due, or perform any term hereof, after not less than three (3) days written notice of such default given in the manner required by law, Owner, at his option may terminate all rights of lessee hereunder, unless Lessee, within said time, shall cure such default. If Tenant(s) abandons or vacates the property, while in default of the payment of rent, Owner may consider any property left on the premises to be abandoned and may dispose of the same in any manner allowed by law.

Security The security deposit in the amount of $500 shall secure the performance of Tenant(s) obligations hereunder.Owner may, but shall not be obligated to, apply all or portions of said deposit on account of Tenant(s) obligations hereunder. Any balance remaining upon termination shall be returned to Tenant(s). Tenant(s) shall not have the right to apply the security deposit in payment of any portion of the rental fee.

Right of Entry Owner reserves the right to enter the demised premises at all reasonable hours for the purpose of inspection, and whenever necessary to make repairs and alterations to the demised premises. Tenant(s) hereby grants permission to Owner to show the demised premises to prospective purchasers, mortgages, tenants, workmen, or contractors at reasonable hours of the day.

Deposit Refunds. The balance of all deposits shall be refunded within two (2) weeks, (21) days in California from the date possession is delivered to Tenant(s), together with a statement showing any charges made against such deposits by the Owner.

Termination This Agreement and the tenancy here by granted may be terminated at any time by either party hereto by giving to the other party not less than one full month’s prior notice in writing.

Attorney’s Fees. The prevailing party in an action brought for the recovery of tent or other moneys due or to become due under this lease or by reason of a breach of any covenant herein contained or for the recovery of the possession of said premises, or to compel the performance of anything agreed to be done herein, or to recover for damages to said property, or to enjoin any act contrary to the provision hereof, shall be awarded all of the costs in connection therewith, include but not by way of limitation, reasonable attorney’s fees.

Radon Gas Disclosure As required by law, (Owner) (Tenant) makes the following disclosure: “Radon Gas” is a naturally occurring radioactive gas that, when it has accumulated in the building in sufficient quantities, may present health risks to persons who are exposed to it over time. Levels of radon that exceed federal and state guidelines have been found in buildings in the state of California. Additional information regarding radon and radon testing may be obtained from your county public health unit.

Lead Paint Disclosure Every purchaser or Tenant(s) of any interest in residential real property on which a residential dwelling was built prior to 1978 is notified that such property may present exposure to lead-based paint that may place young children at risk of developing lead poisoning. Lead poisoning in young children may produce permanent neurological damage, including learning disabilities, reduced intelligence quotient, behavioral problems and impaired memory. Lead poisoning also posed a particular risk to pregnant women. The seller or Tenant(s) of any interest in residential real estate is required to provide the buyer or lessee with any information on lead-based paint hazards from risk assessments or inspection in the seller or Owner’s possession and notify the buyer or Tenant(s) of any known lead-based paint hazards. A risk assessment or inspection for possible lead-based paint hazards is recommended prior to purchase.

Additional Terms and Conditions There will be a $95 cleaning fee applied to all rentals upon departure. A security deposit of $500 will be required and is fully refundable if no loss or damages have been done. In case of cancellation due to emergency Tenant(s) can have 1 week at another time, however, cancellation must be given with reasonable notice. The Tennant(s) respectfully asks that smoking is done outside the unit. Please do not move the furnishings or wash any of the top bedding, an automatic fee of $150 will be charged. Owner is not responsible for any lost, stolen or abandoned articles. Tenant(s) agrees to hold Owner harmless for Tenant(s) use of the property, including damage or injury to persons or their personal property during the term of this agreement, resulting from any cause what-so-ever. Owner shall not be liable for any interruption or inconvenience arising from any temporary defects or stoppage of water, electricity, plumbing, weather conditions, natural disasters, acts of God or other events beyond Owner’s control. Any plumbing problems caused by the Tenant(s) will be charged to the Tenant(s) and/or taken out of the deposit.

Entire Agreement This document constitutes the entire Agreement between the parties, and no promises or representations, other than those contained here and those implied by law, have been made by the Owner or Tenant(s). Any modifications to this Agreement must be in writing signed by the Owner and Tenant(s).


Check-In/Check-Out: You may check in at any time after 12:00 PM on the day of your arrival. The check out time 10:00 AM on the day of your departure. Please arrange ahead of time if you will need an extended time.

Access to Unit: There will be a code assigned to you two weeks prior to your arrival with access to the Unit. Please remember to lock the door with the “lock key pad symbol” each time you leave the residence.

Security Deposit: The security deposit will be returned to you with in two weeks of your departure after the unit has been checked for damages.

Laundry Room: Keys to the laundry room are in the front entrance draw (left side) as you come in the unit. The laundry room is located just outside the entrance door through the double doors.

Please remove all of the sheets from the beds and put all of the dirty towels in the laundry room or front hallway. If you can, please start a load before you leave. Thanks.

Dishes: Always run the disposal prior to using the dishwasher to be sure that the drain is clear. Be sure to rinse dishes well prior to placing them in the dishwasher.

Before you check out please run the dishwasher and return the dishes, cups and utensils to their proper cabinets and drawers.

Plumbing: We are on septic tanks. Please do not flush anything down the toilet except human waste and toilet tissue. Kleenex, paper towels, baby wipes, hand wipes, disposable diapers, feminine hygiene products, cigarettes butts, cigar butts may not be flushed down the toilet. In order to avoid clogged drains, do not allow excess hair to go down sinks or tub drains. Because the city has required that we install “low flow” toilets, one must also be careful not to put too much paper in at one time. Despite label instructions, please do not put drano or similar drain products down sinks or toilets. These products may damage or destroy the bacteria necessary to the function of a septic tank. Please advise the owner of any faucet or pipe leaks right away. Tenants will be responsible for any repairs needed to clear clogs caused by foreign objects. Let common sense be your guide.

Disposal of Trash, Garbage and Wastes: Please do not put any hard, sharp or stringy items in the garbage disposal. Such items as banana peels, artichoke, celery, potato peels, onions, coffee grounds, grease, bones, citrus rinds, egg shells etc. should not be put down the garbage disposal at any time. When in doubt, bag it! Please bag all of your trash and garbage before placing it in the receptacles next to the carport.

Before you check out please take out any trash that contains food items.

Lights and AC/Heating: Turn off all lights and fans. If it is the summer please set the AC on 90 degrees before you depart. If it is the winter please turn the heating to off.

Golf Cart and Bikes: No person may drive a golf cart on the Villa grounds unless able to produce a valid driver’s license. The golf course is private property and you must be a member to access it. The garage door opener is located in the front entrance draw (left side) as you come in the unit. The garage is located just on the other side of the laundry room. This is where the bikes and golf cart is located.

Parking: Stall letter “S” is the designated parking space for our bungalow. Please do not tandem park in this space you will block the trash receptacle area and your car will be towed. Visitor parking is provided as indicated on the map.

Staying Connected: All of the free HBO movie channels are in the 700 range. Please do not charge any movies to the unit. Local calls are free. We provide WIFI internet. If there’s a problem please feel free to call us. To make calls outside the United States we recommend you use SKYPE on the computer (set up a free Skype account at www.skype.com). Skype is free to other Skype accounts and inexpensive to land lines or cells ($.02 per minute).

Activities/Restaurants: Please take a moment to browse through the white binder for local information.

Pool, Spa and Common Areas: Do not use the pool alone. No lifeguards are on duty. Use the pool and spa at your own risk. No glass or animals are allowed in the pool area. Plastic drinking containers are provided in the unit for use at the pool. No running or rough play allowed on the pool deck. Please be respectful of the surrounding neighbors. Children under 14 must be accompanied by an adult at all times. Children in diapers are not allowed in the pool. Pool hours are from 7 AM to 10 PM. We are not responsible for accidents or injuries. No diving is allowed. Spa is for adult use only. Elderly persons, pregnant women, infants and those with health condition requiring medical care should consult a qualified physician before entering the spa. Hot water immersion while under the influence of alcohol, narcotics, drugs or medicines may lead to serious consequences and in not recommended. Please replace all deck furniture to there original positions after use. When leaving the pool area, empty ashtrays and any other disposables in the trash receptacle near the mail boxes.
